GENERAL RULES FOR K-EARTH 101 and K-EARTH HD-2

K-EARTH 101 and K-EARTH HD-2 (the "Station") may change the dates and/or terms of the contest or promotion (the “Contest”) without prior notice. Any material changes will be broadcast on the Station and/or posted on its website located at www.kearth101.com. Unless otherwise specified in Contest Rules or other station instructions, these general rules will apply to all Station Contests. Special individual promotional contest rules supersede or are in addition to the General K-EARTH 101 Contest Rules when indicated and posted.
Unless otherwise specified, the Contest is open to all Station listeners who are legal U.S. residents age 18 or older and who reside in the Los Angeles, Orange County, Ventura, San Bernardino, Riverside or San Diego metropolitan areas. Employees of the Station, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Los Angeles, Orange County, Ventura, San Bernardino, Riverside or San Diego metropolitan areas and the members of their immediate families and/or households are ineligible to participate or win. Any person or persons in your immediate household or family may qualify or win a Station contest.
When listening to play call in contests: Contestants’ chances of winning are increased by listening to
K-EARTH 101 FM. If listening via online streaming, contestants are hereby notified that internet streaming is not played in real time. There is a delay from what is heard on K-EARTH 101 FM.
Only one winner per household is permitted in any contest during the contest period.
Listeners can only win one (1) contest either on-air or online at www.kearth101.com per thirty (30) day period, unless otherwise stated.
Any listener who wins a single contest valued at more than $600 is ineligible to win any other contest on
K-EARTH 101 for ninety (90) days.
For entries by mail, the Station is not responsible for lost, stolen, mangled, misdelivered, illegible, incomplete or late entries. When applicable, the Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call. When applicable, the Station is not responsible for facsimile transmission errors, illegible entries, telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent transmitting his/her facsimile entry. For internet entries, the Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
Upon notification of potential prize award, all prizes or prize certificates may be picked up at the office of the Station located at 5670 Wilshire Blvd., Suite 200, Los Angeles, CA 90036. The winner will forfeit any prize or prize certificate not claimed within thirty (30) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate. Any lost or misdelivered prize or prize certificate will not be replaced.
There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses, which are the sole responsibility of the winner. Other restrictions may apply.
Decisions of the Station management with respect to the Contest are final.
Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent. Any winner who receives one (1) prize with a value of $600 or more will be required to execute a release form and a Form W-9, and will be issued a Form 1099 for the fair market value of the prize. The winner will be required to provide valid CA picture ID and social security card.
Any winner who receives a cash prize (regardless of dollar amount) will be required to execute a release form, a Form W-9 and must provide a valid CA picture ID and proof of social security number in order to accept prize. To the extent that any prize consists of airline tickets and/or hotel reservations, the Station is not responsible for any cancellation, postponement, or overbooking. Unless we inform you otherwise, contest prizes are not transferable or redeemable for cash. Any misplaced or lost prize or prize certificates will not be replaced.
By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parents, subsidiaries, and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.
Failure to comply with the Contest rules may result in an entrant’s disqualification solely at the discretion of the Station.
The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
Copies of the written Contest rules and a list of winners (when complete) are available during regular business hours at the main studio of K-EARTH 101 or K-EARTH HD2 5670 Wilshire Boulevard, Suite 200, Los Angeles, CA 90036.
