1. How to Enter the Contest:
a. The K-EARTH 101 “Beat the Pump” contest will take place Monday, January 7 – Friday, December 26, 2008, between the hours of 5:00 AM – 10:00 AM Pacific Time (“PT”).
b. To participate in the contest, there is one way to enter:
Enter by Listening: Contestants must listen to K-EARTH 101 weekday mornings between 5 am to 10am PT during the contest period for the on-air personality to announce that they are going to play, “Beat the Pump.” Listeners must call 1-800-232-KRTH immediately after the on-air personality announces he is taking callers. The designated numbered caller as announced will be selected. If the designated caller correctly “Beats the Pump,” they will win a prize, such as 101 gallons of gas, upon confirmation of contest eligibility.
To play, the contestant will listen to a pre-recorded tape. This recording will announce various prizes, such as gallons of gas, movie screening tickets, etc.
The contestant must say “stop” before the pump sound effect (losing sound effect) goes off. The next prize recorded on the tape after the winner says, “stop” is what they will win.
If the sound effect (losing sound effect) goes off, the contestant’s turn is over. He/she will win a K-EARTH 101 t-shirt for participating.
If the contestant successfully avoids the pump sound effect (losing sound effect), he/she could win, gas (exact number of gallons to be determined) or other miscellaneous prizes. The most a contestant can win will be 101 gallons of gas to be sent to the winner in the form of a check (assuming that the average gallon of gas is $3.50/gallon.)
Should the designated caller not “Beat the Pump,” his/her participation will end. Another caller may be taken. The number of times this game is played will be determined by the number of gallons of gas awarded, not to exceed 101 gallons total, per day.
K-EARTH 101 is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call.
c. Participants may call as often as they wish, but may only win once. Limit one winner per household.
d. If the participating contestant is confirmed as a registered K-EARTH 101 online “All Access Member” with a valid account. If a prize of a number of gallons is announced, that number will be automatically increased by ten gallons. Example: If 64 gallons is announced as the prize, and the contestant is a valid K-EARTH 101 “All Access Member,” they will be awarded 74 gallons. This applies to all amounts announced including 101.
2. Eligibility Restrictions:
a. The contest is open to all K-EARTH 101 listeners who are 18 years of age or older at the date and time contest is played, legal U.S. residents, and who reside in the following Counties: Los Angeles, Orange, San Bernardino, Riverside, San Diego and Ventura. Employees of K-EARTH 101, its licensee, its parent corporation, subsidiaries and affiliates, their advertising agencies, participating sponsors/promotional partners, other radio stations in the Los Angeles, Orange, San Bernardino, Riverside, San Diego and Ventura metropolitan areas and the members of their immediate families are ineligible to participate or win.
b. Listeners are eligible to win a K-EARTH 101 contest with a prize value of up to $599 only once every sixty days. Any contest won with a prize valued at $600.00 or more, the listener is eligible to win again after six months.
c. Contestants are required to provide truthful information and K-EARTH 101 will reject and delete any entry that it discovers to be false or fraudulent. K-EARTH 101 will also disqualify and delete any entry received from persons under the age of 18.
d. To be eligible for the K-EARTH “All Access Member” gallon “Top Off,” contestant must be a registered K-EARTH 101 “All Access Member” with a valid account, prior to participation in the contest. To Register log on to www.mykearth101.com and click on the All Access Member link to register. Registration requires name, address, city, zip code, phone number, email, date of birth and gender. Registration is free, no purchase necessary.
3. Prizes:
a. Exact number of participants is dependent upon the prizes won by previous players.
b. If a contest wins gas, they will be issued at a check. A check will be issued in the amount of $2.75/per gallon of gasoline that the contestant wins. The amount of the prize will be determined by the contestants’ participation in the game.
b. Prize checks will be made payable to the winner’s name given at the time of winning. Prize checks will be mailed to the address given at the time of winning. Prize checks will not be processed until K-EARTH 101 receives a completed W-9, copy of winner’s California ID/Drivers License, Social Security Card and a signed copy of these rules. The winner will forfeit any prize for which the winner does not submit complete paperwork for within thirty (30) days of winning. K-EARTH 101 is not responsible for the safe arrival of a prize or prize certificate.
f. There is no substitution or transfer of prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value. The prizes are expressly limited to the item listed above and do not include taxes. Other restrictions may apply.
4. Selection of Winners:
a. Decisions of station management with respect to the contest are final.
b. Winners will be selected as per section 1.b. of these Official Rules.
c. Winners need not be present, but Winners need to listen to win.
d. Odds of winning a Prize depend upon the number and timing of calls received.
5. Conditions:
a. Payment of all federal, state and local taxes will be the sole responsibility of the winner. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the contest, participants and winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional notification or compensation (financial or otherwise). The winner or winners (and their guest or traveling companion, if any) agree to sign a publicity release authorizing the same prior to acceptance of a prize.
c. Prior to awarding any prize or prize certificate, K-EARTH 101 in its sole discretion may require contest winners to sign a liability release, agreeing to hold K-EARTH 101, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. K-EARTH 101 reserves the right to make changes in the rules of the contest, including the substitution of a prize or prizes of equivalent or greater value, which will become effective upon announcement.
e. Failure to comply with the contest rules may result in a contestant’s disqualification, at the sole discretion of K-EARTH 101.
f. K-EARTH 101 is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.
g. Copies of the written contest rules and a list of all winners are available during regular business hours at the main studio of K-EARTH 101, 5670 Wilshire Boulevard, Suite 200, Los Angeles, CA 90036, or by sending a self-addressed stamped envelope to K-EARTH 101.
h. K-EARTH Promotions must validate all claims of All Access Membership, before additional amounts of gallons will be awarded. If a contestant claims to be a valid K-EARTH 101 “All Access Member” and is found by K-EARTH promotions to be invalid. That contestant will only be awarded the originally announced prize or amount of gallons.
