K-EARTH 101 - BEAT THE PUMP PROMOTION
Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. How to Enter:
a. These rules govern the K-EARTH 101 “Beat the Pump” Promotion (the “Promotion”) being conducted by KRTH-FM (the “Station” ) beginning on Monday, January 5, 2009 and ending on Friday, December 18, 2009, between the hours of 5:00am – 10:00am Pacific Time (“PT”).
b. To participate in the Promotion, you may enter via the following method only: Enter by Listening: Contestants must listen to the Station weekday mornings (once per day on Monday, Tuesday, Thursday and Friday and twice on Wednesday) between 5:00am to 10:00am PT during the Promotion period for the on-air personality to announce that they are going to play, “Beat the Pump.” Listeners must call 1-800-232-KRTH immediately after the on-air personality announces he is taking callers. The designated numbered caller as announced will be selected. If the designated caller correctly “Beats the Pump,” they will win a prize, such as 101 gallons of gas, upon confirmation of Promotion eligibility.
To play, the contestant will listen to a pre-recorded tape. This recording will announce various amounts of gallons of gas.
The contestant must say “stop” before the pump sound effect (losing sound effect) goes off. The next prize recorded on the tape after the winner says, “stop” is what they will win.
If the sound effect (losing sound effect) goes off, the contestant’s turn is over. He/she will not be awarded a prize.
If the contestant successfully avoids the pump sound effect (losing sound effect), he/she could win, gas (exact number of gallons to be determined). The most a contestant can win will be 101 gallons of gas to be sent to the winner in the form of a check (based on the average price of a gallon of gas at the time of play. See 3.b for more details.)
Should the designated caller not “Beat the Pump,” his/her participation will end. Another caller may be taken. The number of times this game is played will be determined by the number of gallons of gas awarded, not to exceed 101 gallons total, per day.
Decisions of the Station are final with respect to timing in all aspects of the game, including when the caller says “stop” and when the pump sound effect goes off. All prizes are awarded subject to confirmation of eligibility. At the time of their call, all designated callers who are not disqualified will be required to provide their first and last name, complete address, city, state, zip code, telephone number, and date of birth. There is no limit to the number of times a listener may attempt to call in to win, but a listener may only win a prize once in the Promotion. The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call. Due to delays in the KRTH online streaming of its broadcast signal, listeners to the online stream may not be able to participate in or may be disadvantaged in participating in on-air contests.
c. Participants may call as often as they wish, but may only win the Beat the Pump Promotion once per year. Limit one winner per household.
d. If the participating contestant is confirmed as a registered K-EARTH 101 online “All Access Member” with a valid account, and if the prize is a number of gallons of gas, then that number will be automatically increased by ten (10) gallons. Example: If 64 gallons is announced as the prize, and the contestant is a valid K-EARTH 101 “All Access Member,” they will be awarded 74 gallons. This applies to all amounts announced including 101.
2. Eligibility Restrictions:
a. The Promotion is open to all persons who are 18 years of age or older and who reside in the following Counties: Los Angeles, Orange, San Bernardino, Riverside, San Diego and Ventura. Employees of Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and Promotional agencies, its participating sponsors, other radio stations in the Los Angeles metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
b. Only one winner per household is permitted in any Promotion during the Promotion period (Beat the Pump Promotion period is one year). Listeners are eligible to win a prize in a Promotion conducted by the Station only once every thirty (30) days for prizes valued at or under $600, prizes valued from over $600 to $1,000 can win once every (60) days, and prizes valued at over $1,000 can win once per year. Only one (1) winner per household is permitted in any Station Promotion.
c. The winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.
d. To be eligible for the K-EARTH “All Access Member” gallon “Top Off,” contestant must be a registered K-EARTH 101 “All Access Member” with a valid account, prior to participation in the Promotion. To Register log on to www.kearth101.com and click on the All Access Member link to register. Registration requires name, address, city, zip code, phone number, email, date of birth and gender. Registration is free, no purchase necessary.
3. Prizes:
a. There will be (6) participants per week, (except during special or holiday programming), number of prizes awarded will vary depending on the performance of participants. Example: If a participant says “stop” on the (0) gallons of gas in the Promotion they lose and no prize is awarded, but if a winner says “stop” on 100 gallons of gas then the prize will be 100 gallons of gas. The maximum number of gallons that will be awarded is 100 for non K-EARTH 101 “All Access Members” or 110 gallons of gas for K-EARTH 101 “All Access Members” with valid accounts, prior to participation in the Promotion.
b. If a contestant wins gas, the prize will be awarded in the form of a check. The check will be issued in the amount equal to the total price/ number of gallons of gasoline (Based on AAA’s Los Angeles Average) that the contestant wins. The amount of gallons awarded as the prize will be determined by the contestants’ participation in the game.
c. Prize checks will be made payable to the winner’s name given at the time of winning. Prize checks will be mailed to the address given at the time of winning. Prize checks will not be processed until K-EARTH 101 receives a completed W-9, copy of winner’s California ID/Drivers License, Social Security Card and a signed winner affidavit. The winner will forfeit any prize for which the winner does not submit complete paperwork for within thirty (30) days of winning. The prize check process can take up to eight weeks at minimum. K-EARTH 101 is not responsible for the safe arrival of a prize or prize certificate.
d. There is no substitution or transfer of prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value. The prizes are expressly limited to the item listed above and do not include taxes. Other restrictions may apply.
4. Winner Selection and Notification
a. Decisions of station management with respect to the Promotion are final.
b. Winners will be selected as per section 1.b. of these Official Rules.
c. Winners need not be present, but Winners need to listen to win.
d. Odds of winning a Prize depend upon the number and timing of calls received.
e. The winner must execute and return any required affidavit of eligibility and/or liability/publicity release within thirty (30) days of winning or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.
5. Conditions:
a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.
d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Station will select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date.
e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.
f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.
h. K-EARTH Promotions must validate all claims of All Access Membership, before additional amounts of gallons will be awarded. If a contestant claims to be a valid K-EARTH 101 “All Access Member” and is found by K-EARTH Promotions to be invalid. That contestant will only be awarded the originally announced prize or amount of gallons.
i. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by December 18, 2009 to “BEAT THE PUMP PROMOTION– Official Rules,” Attn: Promotions, KRTH-FM 5670 Wilshire blvd. suite 200, Los Angeles, CA 90036. For the names of the prize winners send a self-addressed stamped envelope for receipt by February 18th 2010 to the above address marked BEAT THE PUMP PROMOTION– Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and shall be posted online at www.kearth101.com
